Terms of Service

These Terms of Service ("Terms") govern your use of huigantea.com and everything we offer through it (the "Services"). The store is operated by Solluvia Co., Ltd. (日雨記有限公司), a Taiwan-registered company. "We," "us," and "our" mean Solluvia Co., Ltd.; Hui Gan (回甘) is our tea brand. Our store is powered by Shopify, which lets us provide the Services to you.

Please read these Terms carefully — they include important information about your rights, including warranty disclaimers and limits on our liability. By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

1. Access and account. You confirm you are at least the age of majority where you live, and that any minor in your household uses the Services only with your consent and supervision. To order, you may need to give us your email, billing, payment, and shipping details. You confirm that information is accurate and current, and that you have the right to provide it. You're responsible for keeping your account secure and for activity on it. You may not transfer, sell, or assign your account to anyone else.

2. Our products. Our teas contain caffeine. They are food, not supplements, and are not intended to diagnose, treat, cure, or prevent any condition — we make no health or medical claims. If you are pregnant, nursing, sensitive to caffeine, or managing a medical condition, talk to your doctor before drinking them. Our teas are Chinese — grown in Yunnan, Wuyi (Fujian), and Fuding; Solluvia Co., Ltd. is the Taiwan-registered company that conducts quality checks for each harvest and publishes a lab assay for every lot. Harvests are limited and seasonal, so a tea can sell out or vary between harvests. Colors and packaging may look slightly different on your screen than in person. We may change product descriptions, discontinue products, or limit quantities at any time.

3. Orders. When you place an order, you're making an offer to buy. We may accept or decline any order at our discretion, and your order isn't accepted until we confirm it and process your payment. Please review your order before submitting it — we may not be able to change or cancel it after it's accepted. If we cancel or change an order, we'll try to reach you using the contact details you gave us. Returns and refunds follow our Return and Refund Policy. You confirm your purchases are for personal or household use, not for resale or export. We may decline or limit a refund, return, or guarantee claim where we reasonably believe it is fraudulent or abusive.

4. Prices and payment. Prices are in U.S. dollars and can change without notice; the price that applies is the one shown when you place the order and confirmed in your order email. Posted prices don't include taxes unless we say so (Canadian duties and taxes are prepaid by us — see the Shipping Policy). You confirm the payment details you give us are accurate, that you're authorized to use the payment method, and that you'll pay the charges. We may correct pricing errors and refuse or cancel affected orders, including after you've ordered.

5. Shipping and delivery. Delivery times are estimates, not guarantees, and we're not responsible for delays caused by carriers, customs, or events outside our control. How we handle lost, delayed, and undelivered orders is set out in our Shipping Policy. As a legal matter, once we hand a package to the carrier, title and risk of loss pass to you — but our Shipping Policy explains how we step in to make things right.

6. Intellectual property. The Services — including all text, images, graphics, video, audio, design, and their selection and arrangement — are owned by Solluvia Co., Ltd. or its licensors and protected by intellectual property laws. You may use the Services for personal, non-commercial use only. You may not copy, reproduce, modify, republish, distribute, or transmit any of it without our written permission. Hui Gan (回甘), the Hui Gan logo, and The 5-Steep Protocol are trademarks of Solluvia Co., Ltd.; please don't use them without our written permission. Shopify's marks belong to Shopify. All other marks belong to their owners.

7. Optional third-party tools. We may give you access to third-party tools we don't control or monitor. We provide them "as is," without warranties of any kind and without endorsement, and we're not liable for your use of them. Using them is at your own risk, under the third party's own terms.

8. Third-party links. The Services may link to third-party sites we don't control or evaluate. If you leave to visit them, you do so at your own risk, and we're not liable for them. Direct any questions about third-party products or services to that third party.

9. Relationship with Shopify. Hui Gan is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Solluvia Co., Ltd. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us.

10. Privacy. The personal information we collect through the Services is handled under our Privacy Policy, and some information may also be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit is shared with Shopify and partners that may be located in other countries to provide the Services. Please read our Privacy Policy for the details.

11. Feedback. If you send us ideas, suggestions, reviews, or other feedback, you grant us a perpetual, worldwide, royalty-free, sublicensable license to use it for any purpose, including commercially. You confirm you own the rights to it, that you've disclosed any compensation behind it, and that it doesn't break these Terms or anyone's rights. We're not obligated to keep it confidential, pay for it, or respond, and we may remove feedback we find unlawful or objectionable.

12. Errors and corrections. The Services may occasionally contain typos, inaccuracies, or omissions about products, prices, promotions, shipping, or availability. We may correct these and change, update, or cancel orders if information was inaccurate — even after you've ordered — without prior notice.

13. Prohibited uses. Use the Services lawfully only. Don't use them for any unlawful purpose; to break any law; to infringe anyone's intellectual property; to harass, abuse, or harm anyone; to send false or misleading information, spam, or malware; to impersonate anyone; to collect others' personal information; to scrape or use automated tools against the Services; or to bypass our security measures. We may suspend or terminate access if you break these Terms.

14. Automated agents. If you deploy any software "agent" that acts on your behalf to access the Services, it must clearly identify itself as an agent in its request headers ("Agent/[agent name]"), must not disguise itself as a human or mimic human behavior, must not complete or bypass CAPTCHAs or other human-verification measures, must answer truthfully when asked whether it's human or automated, and must not circumvent any controls we use on agent access. We may limit agent access by technical means.

15. Termination. We may terminate this agreement or your access to the Services at any time, at our discretion, without notice, and you remain liable for amounts owed up to termination. Sections that by their nature should survive — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Privacy — continue to apply.

16. Disclaimer of warranties. The information on the Services is provided for general purposes only; we don't warrant its accuracy, completeness, or usefulness, and you rely on it at your own risk. EXCEPT AS EXPRESSLY STATED BY US, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DON'T ALLOW THESE DISCLAIMERS, SO THEY MAY NOT FULLY APPLY TO YOU.

17. Limitation of liability. TO THE FULLEST EXTENT ALLOWED BY LAW, SOLLUVIA CO., LTD. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SUPPLIERS — AND THOSE OF SHOPIFY — WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE. SOME JURISDICTIONS DON'T ALLOW THESE LIMITS, SO THEY MAY NOT FULLY APPLY TO YOU.

18. Indemnification. You agree to defend and hold harmless Solluvia Co., Ltd., Shopify, and our affiliates and personnel from claims, losses, and reasonable legal fees arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services. We'll notify you of any such claim and may control its defense at your expense; you'll cooperate as needed.

19. Severability. If any provision is found unlawful or unenforceable, it will be enforced to the fullest extent allowed, and the rest of these Terms will stay in effect.

20. Waiver; entire agreement. Our failure to enforce any provision isn't a waiver of it. These Terms and the policies posted with them are the entire agreement between you and us about the Services, and they replace any prior versions or understandings.

21. Assignment. You may not transfer or assign these Terms without our written consent. We may assign them without notice to you.

22. Governing law. These Terms are governed by the laws of Taiwan (Republic of China), where Solluvia Co., Ltd. is registered. This does not limit any consumer-protection rights you cannot waive in your home country or state.

23. Headings. Headings are for convenience only and don't affect these Terms.

24. Changes. You can always find the current Terms on this page. We may update them by posting changes here, and we'll give notice of material changes as the law requires. Continuing to use the Services after changes are posted means you accept them.
